Terms of Service
These Terms of Service (the "Terms") set forth the conditions for using "iknow.dev" (the "Service") provided by iknow, Inc. (the "Company"). By using the Service, you agree to be bound by these Terms.
1. Application
These Terms apply to all relationships between users and the Company concerning the use of the Service. Individual rules and guidelines that the Company may publish on the Service from time to time form part of these Terms. If an individual rule conflicts with these Terms, the individual rule prevails.
2. Accounts
Some features of the Service require account registration. Users shall keep their registered information true and accurate and shall manage their accounts at their own responsibility. The Company is not liable for damages arising from unauthorized use of an account, except in cases of the Company's willful misconduct or gross negligence.
3. Intellectual Property and User Content
Copyright in knowledge, chats, and other content that users post to the Service belongs to the user or other rightful owner. Users grant the Company a royalty-free license to use posted content to the extent necessary to provide, improve, and promote the Service (including reproduction, display, and reference or summarization by AI). All intellectual property rights in the Service itself belong to the Company or its licensors.
4. Prohibited Conduct
When using the Service, users must not engage in conduct that violates laws or public order and morals, infringes the intellectual property, privacy, or other rights of third parties, registers false or misleading information, interferes with the operation of the Service, involves unauthorized access or reverse engineering, or is otherwise deemed inappropriate by the Company.
5. AI-Generated Information
The Service uses AI to generate chat responses and other information based on registered knowledge. AI-generated information may contain errors or inaccuracies, and the Company does not guarantee its accuracy, completeness, or usefulness. Users use generated information, and make decisions based on it, at their own responsibility.
6. Changes, Suspension, and Termination of the Service
The Company may change, add to, or discontinue all or part of the Service without prior notice to users. The Company may also temporarily suspend the Service in the event of system maintenance, failures, natural disasters, or other unavoidable circumstances.
7. Disclaimer of Warranties
The Company does not warrant, expressly or impliedly, that the Service is free from defects in fact or in law (including defects relating to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, or security, as well as errors, bugs, and rights infringements).
8. Limitation of Liability
The Company is not liable for damages incurred by users arising out of the Service, except in cases of the Company's willful misconduct or gross negligence. However, this exemption does not apply where the contract between the Company and a user concerning the Service constitutes a consumer contract under the Consumer Contract Act of Japan.
Even where the proviso above applies, the Company is not liable for damages arising from special circumstances (including cases where the Company or the user foresaw or could have foreseen such damages) caused by the Company's slight negligence, whether in contract or in tort. In such cases, the Company's total liability is capped at the total amount the user has paid to the Company (or JPY 10,000 if no payment has been made).
9. Restriction of Use and Account Deletion
If a user violates these Terms, the Company may delete posted content, restrict the user's use of the Service, or delete the user's account without prior notice. The Company is not liable for damages incurred by the user as a result, except in cases of the Company's willful misconduct or gross negligence.
10. Amendments to These Terms
The Company may amend these Terms in accordance with the provisions of the Civil Code of Japan concerning standard terms of contract, where the amendment conforms to the general interest of users or is reasonable and not contrary to the purpose of the contract. When amending these Terms, the Company will set an effective date and give advance notice by posting on the Service or by other appropriate means.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of Japan. Any dispute arising in connection with the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
